TERMS OF SERVICE

If you do not meet these conditions, you must not use the Platform.

You must be at least 18 years of age to create an account and use the Platform without restriction. You must also be legally capable of entering into a binding contract under the laws of your jurisdiction.

Users who are at least 13 years of age but under 18 may access the Platform only with the express, verifiable consent and ongoing supervision of a parent or legal guardian. By allowing a minor to use the Platform, the parent or guardian:

• Agrees to be bound by these Terms on behalf of the minor
• Accepts full responsibility for the minor’s use of the Platform
• Consents to the collection and processing of the minor’s personal data in accordance with our Privacy Policy

LetsQualifly does not knowingly permit children under 13 years of age to create accounts. If we become aware that a user is under 13 and has no parental consent on file, we will terminate that account immediately.

• Progress visualisation and historical score comparison

LetsQualifly uses AI-assisted scoring models to evaluate practice responses across speaking, writing, reading, and listening tasks. We also provide a CLB (Canadian Language Benchmarks) calculator and score-to-band conversion tools.

IMPORTANT — AI Scoring Disclaimer: LetsQualifly’s AI-based scoring tools aim to provide a close approximation of official exam scoring, but AI results are NOT identical to scores awarded in official examinations. They should be used for practice, self-assessment, and guidance only. AI scores must not be submitted to IRCC, any immigration authority, or any official body as evidence of language proficiency. LetsQualifly does not warrant the accuracy of AI scores and accepts no liability for any reliance placed on them.

Score Conversion Disclaimer: All CLB calculations and score conversion results are for informational guidance only. They are not official assessments and carry no legal weight. LetsQualifly is not affiliated with IRCC, British Council, IDP, CELPIP Testing, or Pearson. Always consult official sources and a qualified immigration professional for immigration decisions.

• Preference settings for target exam and destination country
• Email notifications for account activity and platform updates (where consented)

LetsQualifly is not liable for scoring errors, lost sessions, or degraded performance resulting from unsupported devices, browsers, or network conditions.

To access most features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You may register only one account for yourself. Registering multiple accounts, or registering on behalf of another individual without their knowledge, is prohibited.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Use a strong, unique password and not share it with others
• Not share your login credentials with any third party for any reason
• Notify us immediately at privacy@letsqualifly.app if you suspect unauthorised access
• Not use another person’s account without their express permission

LetsQualifly will not be liable for any loss or damage arising from your failure to maintain account security. Credential sharing may result in immediate account suspension without refund.

You may request account deletion at any time by contacting privacy@letsqualifly.app. Upon deletion, your personal data will be handled as described in our Privacy Policy.

You may use the Platform solely for lawful, personal, non-commercial purposes related to immigration language exam preparation, in accordance with these Terms.

You agree not to:

• Use the Platform to cheat, circumvent, or undermine the integrity of any official examination process
• Reproduce, distribute, sell, sublicense, or commercially exploit any Platform content without our written consent
• Scrape, crawl, or systematically extract data from the Platform using automated tools
• Attempt to gain unauthorised access to any part of the Platform, its servers, or related systems
• Upload, transmit, or distribute malware, viruses, or any harmful or disruptive code
• Impersonate another person or entity, or misrepresent your affiliation with any person or entity
• Register more than one account for yourself, or register an account on behalf of another individual without their consent
• Share your login credentials with any third party or use another user’s account
• Attempt to manipulate, falsify, or exploit the Platform’s AI scoring systems
• Harvest, collect, or use other users’ email addresses or personal information
• Send unsolicited commercial messages, spam, chain letters, or promotional content through the Platform
• Use the Platform in any way that violates applicable laws or regulations
• Post, submit, or transmit content that is defamatory, obscene, offensive, or infringes third-party rights
• Interfere with or disrupt the integrity or performance of the Platform

Violation of these prohibitions may result in immediate suspension or termination of your account and may expose you to legal liability.

All content, features, and functionality on the Platform — including but not limited to text, graphics, practice questions, software, algorithms, logos, and interface design — are owned by LetsQualifly or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, LetsQualifly grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial exam preparation purposes. This licence does not include the right to:

• Copy, modify, or create derivative works of any Platform content
• Use any data mining, robots, or similar data gathering or extraction methods
• Download or store Platform content (other than page caching that occurs naturally through browser use)

IELTS, CELPIP, PTE Academic, and CLB are trademarks of their respective owners. LetsQualifly is not affiliated with, endorsed by, or a partner of IRCC, British Council, IDP Education, CELPIP Testing, or Pearson. Reference to these organisations and their examinations is for descriptive purposes only.

If you submit feedback, suggestions, or ideas about the Platform, you grant LetsQualifly a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose, without obligation of compensation or attribution.

LetsQualifly currently offers free access to core platform features. Paid subscription tiers or one-time purchases may be introduced in the future. Separate pricing terms will be presented to you before any purchase, and those terms will supplement these Terms.

When paid subscriptions are available, each package will have a defined validity period beginning immediately upon successful purchase and activation. Unless otherwise stated:

• Access expires automatically at the end of the validity period
• Unused days, unused test attempts, or periods of inactivity cannot be carried forward, paused, or compensated
• Subscriptions and test attempts are strictly non-transferable between accounts

LetsQualifly accepts payment through approved third-party payment gateways, which may include providers such as Razorpay, Stripe, or PayTM depending on your region. Accepted methods include major credit and debit cards (Visa, Mastercard) and other methods listed at point of purchase. All transactions are subject to the payment gateway’s own terms and conditions.

LetsQualifly does not store complete card numbers, CVV codes, UPI PINs, or other sensitive payment credentials.

If a payment transaction fails but an amount has been deducted from your account, the refund of that amount will be handled directly by the payment gateway in accordance with their policies. LetsQualifly will assist you in raising a dispute with the gateway where possible, but is not responsible for delays caused by the gateway or your financial institution.

LetsQualifly reserves the right to cancel or modify orders placed at an incorrect price due to obvious pricing errors. We will notify you if this occurs and offer a refund of any amount paid.

LetsQualifly does not display advertising and does not charge any fees without your explicit consent. You will always be informed of any charges before they are applied.

LetsQualifly may offer promotional discount codes from time to time. The following rules apply:

• Codes must be applied before their stated expiry date; expired codes will not be honoured
• Only one promotional code may be applied per transaction; codes cannot be combined
• Codes are non-transferable and have no cash value
• LetsQualifly reserves the right to modify, restrict, or discontinue any promotional offer without prior notice
• Fraudulent use or misuse of promotional codes may result in account suspension

As the Platform is currently free to use, no payment refunds are applicable at this time.

When paid features are introduced, the following default refund policy will apply unless a different policy is stated at the point of purchase:

• You may request a full refund within 7 days of purchase, provided you have not accessed or consumed a substantial portion of the paid content
• Accessing or using AI-evaluated grading services (including essay grading or speaking feedback) voids your eligibility for a refund under this clause
• Requests must be submitted to legal@letsqualifly.app within the refund window

LetsQualifly may offer a score improvement guarantee for specific paid packages. Where such a guarantee is offered, it will be clearly stated at the point of purchase, along with the eligibility conditions (which may include completing all course materials, submitting a score report, and requesting the refund within a defined period). Guarantee terms supplement but do not replace this refund policy.

Unless otherwise required by applicable consumer protection law, refunds will not be issued where:

• The refund request is made outside the stated refund window
• The paid content has been substantially accessed or downloaded
• The account has been suspended or terminated for breach of these Terms
• The refund request is based on dissatisfaction with AI scoring accuracy

Nothing in this refund policy limits your statutory rights under applicable consumer protection law, including the Consumer Protection Act, 2019 (India) or applicable provincial consumer protection legislation in Canada.

Approved refunds will be issued using the same payment method used for the original purchase. Processing times depend on your financial institution but are typically 5–10 business days.

This clause does not affect your statutory rights and does not override any requirement in applicable law for communications to be delivered by a specific method.

LetsQualifly does not guarantee that use of the Platform will improve your examination scores, increase your chances of immigration success, or lead to any particular outcome. Practice results on the Platform may not reflect performance on official examinations.

Nothing on the LetsQualifly Platform constitutes immigration advice, legal advice, or a substitute for consultation with a qualified immigration professional or lawyer. CLB scores and exam equivalency results provided by our tools are informational estimates only and should not be relied upon for any official immigration purpose.

THE PLATFORM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LetsQualifly DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

LetsQualifly expressly excludes any warranty or representation regarding the accuracy, reliability, or completeness of AI-generated scores. You use AI scoring results entirely at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LetsQualifly AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

In jurisdictions that do not allow the exclusion or limitation of certain warranties or liabilities (including some provinces of Canada and states of India), the above limitations apply to the fullest extent permitted by law.

To the extent LetsQualifly has any liability that cannot be excluded by law, our total aggregate liability to you for any claims arising under or related to these Terms shall not exceed the greater of: (a) the amount you paid to LetsQualifly in the 12 months preceding the claim; or (b) INR 1,000 / CAD 20.

LetsQualifly will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations where such failure or delay arises from events outside our reasonable control (“Force Majeure Event”). Force Majeure Events include, without limitation:

• Strikes, lock-outs, or other industrial action
• Civil commotion, riot, invasion, terrorist attack or threat, war (whether declared or not), or preparation for war
• Fire, explosion, storm, flood, earthquake, epidemic, pandemic, or other natural or public health disaster
• Impossibility of the use of public or private telecommunications networks or internet infrastructure
• The acts, decrees, legislation, regulations, or restrictions of any government or regulatory authority
• Failure of third-party cloud hosting, payment processing, or other infrastructure providers

Our performance is suspended for the duration of the Force Majeure Event. We will make reasonable efforts to resume normal service as soon as practicable and will notify registered users of significant disruption where it is reasonably possible to do so.

LetsQualifly reserves the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We will endeavour to provide reasonable advance notice of material changes that affect your use of the Services.

We may update these Terms from time to time. When we make material changes, we will:

• Update the “Last Updated” date at the top of this document
• Notify registered users by email at least 14 days before the changes take effect
• Post a prominent notice on the Platform

Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Platform and delete your account.

LetsQualifly may suspend or terminate your account and access to the Platform at any time, with or without cause, including where we reasonably believe you have:

• Violated these Terms
• Shared login credentials with third parties
• Attempted to manipulate or exploit the AI scoring system
• Registered multiple accounts in breach of these Terms
• Engaged in fraudulent activity, including payment chargebacks in bad faith

We will give you reasonable notice where practicable, except where immediate action is necessary to protect security, prevent harm, or comply with law. No refund is applicable where an account is terminated for breach of these Terms.

Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, governing law, and dispute resolution) will remain in effect.

Following account deletion or termination, your personal data will be handled in accordance with our Privacy Policy and applicable data retention obligations.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. For users in Canada, certain mandatory consumer protection rights under applicable provincial law (including Ontario’s Consumer Protection Act, 2002, or British Columbia’s Business Practices and Consumer Protection Act) may also apply and are not waived by these Terms.

Before initiating any formal proceeding, you agree to contact us at legal@letsqualifly.app to attempt informal resolution of any dispute. We will make good-faith efforts to resolve disputes within 30 days of receiving your written notice.

If informal resolution fails, you agree that any legal proceedings shall be brought exclusively in the courts of [INSERT CITY — e.g., New Delhi / Faridabad], India, and you consent to personal jurisdiction in those courts. For Canadian users, nothing in this clause limits your right to bring proceedings before applicable consumer tribunals in your province.

To the extent permitted by applicable law, you waive any right to participate in class action litigation or class-wide arbitration against LetsQualifly.

Where a purchase is involved, the legal contract between you and LetsQualifly is formed only when we send you a written order confirmation (including by email). Placement of an order by you constitutes an offer; acceptance by LetsQualifly constitutes the contract.

These Terms, together with the Privacy Policy and any additional terms presented for specific features, constitute the entire agreement between you and LetsQualifly regarding your use of the Platform and supersede all prior agreements.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

LetsQualifly’s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

You may not assign or transfer your rights or obligations under these Terms without LetsQualifly’s prior written consent. LetsQualifly may assign its rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.

Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and LetsQualifly.

These Terms are drafted in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
